Terms of Service

These Terms of Service describe the initial Backfoot service for businesses using the WhatsApp Business Platform.

1. The service

Backfoot provides a shared customer-support inbox for businesses using the WhatsApp Business Platform. The initial service allows authorised team members to receive and respond to customer conversations and manage approved WhatsApp message templates.

2. Eligibility and accounts

You must be authorised to act for the business that uses Backfoot and must provide accurate account information. You are responsible for keeping credentials confidential, limiting access to authorised team members, and notifying us of suspected unauthorised access.

3. Your WhatsApp responsibilities

You are responsible for your use of WhatsApp and for obtaining any customer notices, permissions, or consents required for your messages and support workflow. You must follow Meta’s terms, WhatsApp Business Platform policies, applicable privacy laws, and other laws that apply to your communications. Backfoot is not a substitute for those obligations.

4. Acceptable use

You must not use Backfoot to send unlawful, deceptive, abusive, discriminatory, or harmful communications; infringe another person’s rights; access accounts without authorisation; interfere with the service; attempt to bypass security; or use the service in violation of Meta or WhatsApp policies. We may investigate suspected misuse and take proportionate action.

5. Intellectual property

Backfoot and its software, design, documentation, and branding are owned by Backfoot or its licensors. Subject to these terms, we grant your business a limited, non-exclusive, non-transferable right to use the service for its internal business operations. You retain rights in the content and information you submit, subject to the rights needed for us to provide the service.

6. Availability and changes

We aim to keep Backfoot available, but the service may be interrupted for maintenance, security work, provider outages, or events outside our reasonable control. We may update, improve, or discontinue features. We will provide any notice required by law or an applicable agreement.

7. Suspension and termination

We may suspend or restrict access where reasonably necessary to protect the service, comply with law, respond to a security concern, or address a material breach of these terms or Meta or WhatsApp policies. You may stop using the service at any time. On termination, access may end and information may be handled according to the privacy policy, the business’s instructions, and applicable retention requirements.

8. Third-party services

Backfoot depends on third-party services, including Meta and WhatsApp services and infrastructure providers such as Cloudflare and Supabase. Those services may have their own terms and policies. Backfoot is not responsible for third-party services outside its reasonable control.

9. Liability

To the extent permitted by law, the service is provided without warranties beyond those that cannot lawfully be excluded. Backfoot will not be responsible for indirect, incidental, special, consequential, or loss-of-profit damages arising from use of the service. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.

10. Changes to these terms

We may update these terms by posting a new version on this page. Where required, we will give additional notice. Your continued use of Backfoot after an effective update means the updated terms apply to the extent permitted by law.
